Stamp Duty and Registration Charges in Tamil Nadu Will be 9% of the Property Value

The Tamil Nadu government has declared that the flat registration fee would henceforth be 9% of the property value. This means that the buyer will now have to pay 50% extra in property registration fees.
The stamp duty and registration fee for completed building properties will be 9%. This is the third fee increase by the registration department in the previous three years, including increases in the guideline value and additional services such as construction agreements and power of attorney.
Previously, property registration was charged in two parts, one for each undivided share (UDS) of land and the other for the construction agreement.
The Confederation of Real Estate Developers Association of India (CREDAI) has asked the government to reverse the hikes, claiming that they will hamper the real estate sector’s growth. These increases are likely to deter potential purchasers from investing in real estate.
GPS-Enabled Photo Documents Will Be Mandatory from October 1, 2023, for Land Registration in Tamil Nadu’s Tiruchirappalli (Trichy)

The Department of Registration has made GPS-enabled picture documents mandatory for land and property registration in Tamil Nadu’s Trichy region from October 1, 2023.
The department has made it essential for residents to provide colored images of the land obtained using GPS-enabled equipment. These images supplement the previously supplied materials. The buyer or seller might personally visit the place to obtain the pictures.
The plan’s purpose is to decrease the registration of forged papers. It will also aid in the reduction of fraudulent real estate transactions. Furthermore, the Department of Registration has implemented a new regulation that requires a scanned copy of the advocate’s or document writer’s photograph to be attached to the document, along with their license number. This will aid in the certification that the documentation and draught have been appropriately verified.

Let us understand with an example how stamp duty and registration charges are calculated:-
A house buyer paid Rs 30 lakh for a property, on which he must pay 7% stamp duty and 4% registration fees. A buyer must pay 11% (7% stamp duty and 4% registration fees) of Rs 30 lakh, which is Rs 33,000 in stamp duty and registration fees. A total of 3,33,000 Rs has to be paid.
TN Settlement Deed Registration
In the event of immovable property, the registration of a settlement deed is required in Tamil Nadu. Only the registered document is valid. To register a settlement deed in Tamil Nadu, you would require an original title document (including Patta), an encumbrance certificate, the parties’ identification verification, and Aadhaar proof. You will also be required to pay registration fees and stamp duty. Stamp duty is 1% of the market value of the property, with a maximum of Rs 25,000, while registration costs are 1% of the property value, with a maximum of Rs 4,000.

Stamp paper can be purchased from a treasury or franked. Franking is a way of stamping documents. A stamp on a document signifies that it is legal. You may have to pay franking fees to have the document stamped.
